What does a settlement agent do?

The main task of a settlement agent (also known as a conveyancer) is to transfer ownership of the property. A settlement agent has important responsibilities throughout the entire settlement process. Whilst each settlement is different, a brief summary of our settlement services are provided below.

If you’re buying a property, we will:

  • Ensure the property described in the contract is in fact the property you intend to purchase
  • Search Landgate (Title) records to ensure that:
  • You are aware of any encumbrances which could affect your enjoyment of the property
  • Any encumbrances that should be removed are removed
  • Ensure that all conditions of the contract are completed on time & to your satisfaction
  • Liaise with your lender to ensure that they will be ready to settle on the due date
  • Ensure no outstanding orders have been placed on the property by government departments
  • Prepare the correct documentation for signing by you
  • Ensure that the contract is lodged & stamp duty (if applicable) is paid within the required timeframes
  • Adjust shire & water rates and ensure they are all paid up to date at the time of settlement
  • Attend settlement on your behalf to ensure that documentation is in order & correct funds are paid to the seller
  • Ensure the property is transferred into your name after settlement

If you’re selling a property, we will:

  • Ensure the property described in the contract is in fact the property you intend to sell
  • Ensure that all conditions of the contract are completed on time & to your satisfaction
  • Liaise with your lending institution (and any other party secured by a mortgage/lien on the property) to arrange repayment of debt and removal of the encumbrance/s
  • Liaise with the buyer’s settlement agent to monitor buyer’s progress towards settlement
  • Examine documentation for signing by you
  • Adjust shire and water rates and ensure they are all paid up to date at the time of settlement (and obtain refund from buyer for their share)
  • Attend settlement on your behalf & collect the correct amount due to you and distribute as instructed
